End User License Agreement
This End User License Agreement governs the licensed use of TRGS Application by operators, technicians, managers, owners, and other authorised users.
1. License Grant
Subject to compliance with this agreement, TRGS grants the user a limited, non exclusive, non transferable, revocable license to install and use the application for internal operational, administrative, and governance purposes.
2. Ownership
TRGS is licensed, not sold. All rights, title, and interest in the application, including its software logic, written content, structure, branding, and associated materials, remain with the owner of the application except where third party rights apply.
3. Scope of Licensed Use
The application may be used for management of tank and regulator records, inspection tracking, service visibility, barcode linked retrieval, status control, and related governance functions within a dive operation or similar equipment control setting.
4. Restrictions
You may not copy, resell, sublicense, lease, distribute, reverse engineer, decompile, modify, or create derivative works from TRGS except to the extent such restriction is prohibited by applicable law.
5. User Entered Records
Records entered into TRGS remain the responsibility of the user or operating entity. The license to use the software does not transfer responsibility for data accuracy, maintenance compliance, equipment condition assessment, or operational decisions.
6. Release Stage Limitations
TRGS may be provided in testing, pre release, restricted, or production stages. Feature availability, security controls, sync functions, billing paths, and access methods may change as the application develops.
7. Suspension and Termination
This license may be suspended or terminated if the user breaches this agreement, misuses the application, interferes with release control, attempts unauthorised technical access, or where suspension is required for maintenance, payment handling, security, or legal protection.
8. Updates and Changes
TRGS may issue updates, changes, fixes, release controls, access restrictions, or compatibility requirements over time. Continued use of the application after such changes constitutes acceptance of the updated licensed environment to the extent permitted by law.
9. No Transfer of Operational Judgment
TRGS is a software tool and does not replace technician judgment, maintenance procedures, legal compliance obligations, safety systems, management oversight, or owner accountability.
10. Disclaimer of Warranties
To the maximum extent permitted by law, TRGS is provided on an “as is” and “as available” basis without warranties of uninterrupted availability, error free operation, fitness for a particular purpose, or complete compatibility with every device, workflow, or operating environment.
11. Limitation of Liability
To the maximum extent permitted by law, TRGS shall not be liable for indirect, incidental, consequential, special, or business interruption losses arising from use of, inability to use, or reliance on the application. Operational responsibility remains with the operator and relevant decision makers.
